Breaking Down Immigration Misinformation
What is true and what is not? We explored the top stories floating around social media and broke them down.
In the wake of Trump’s recent executive orders on immigration, there has been a lot of media attention focused on immigration, which has created a lot of fear in the Latino community.
But what is true and what is not? We explored the top issues of concern and broke them down.
Who Does Trump Plan To Deport?
Trump’s Border Czar Tom Homan told ABC News that the federal government does not have the resources to deport every undocumented immigrant. As a result, the federal government plans to focus on people who already have criminal convictions and have already received a deportation order.
That total number is about 1.4 million people, which would take about 3-4 years to carry out.
Is that higher than normal? By comparison, Trump deported about 1.7 million people during his previous term, and Biden deported about 1.5 million people during his previous term.
Homan has stated, however, that the federal government reserves the right to detain anyone who is accompanying someone with a deportation order at the time of arrest.
Did ICE Show Up At A High School?
No, ICE did not show up at a high school. There was a report last week which stated agents had showed up to a high school in Chicago, but that report turned out to be false information.
According to CBS, “The U.S. Secret Service said some of their agents visited Hamline Elementary School while investigating threats made against a government official under the agency's protection.” In other words, ICE never went to a high school.
That said, Trump did rescind the Biden administration’s 2021 guidelines for Immigrations and Customs Enforcement (ICE) and Customs and Border Protection (CBP) that thwart law enforcement in ‘sensitive’ areas. The statement can be read here.
Can ICE Agents Raid A Private Business Without A Warrant?
No, agents cannot raid a private business without a warrant. As CBS reported, ICE agents need a judicial warrant or permission to enter areas not open to the public.
According to CBS, that’s because the Fourth Amendment protects areas where people have a ‘reasonable expectation of privacy.’
“The definition of a private area can differ depending on the business or institution, but it essentially means the space isn’t freely accessible to the public. This could include interiors or areas marked with a private sign.”
Do States Have To Comply?
No, states do not have to comply with the federal government. They are free to make their own policies. However, that does not mean that the federal government cannot pressure states into complying by threatening to pull federal funds from schools and roads.
In addition, the federal government reserves the right to conduct their own arrests because immigration violations are classified as a federal matter.
Was Birthright Citizenship Overturned?
No, birthright citizenship was not overturned. After Trump signed an executive order rescinding birthright citizenship, a circuit judge halted the executive order.
The executive order is now expected to continue through the court system until the Supreme Court issues a ruling that clarifies the 14th Amendment.
