In a significant legal victory, an immigration judge has dismissed the deportation case against Narciso Barranco, a Mexican landscaper and father of three U.S. Marines.
Barranco, who has lived in the United States since the 1990s without legal status, was arrested in June 2025 in Santa Ana, California, during a controversial Immigration and Customs Enforcement (ICE) operation.
Judge Kristin S. Piepmeier ruled on January 28 that Barranco was eligible to seek lawful status due to his three U.S.-born sons serving in the military. The ruling allows Barranco to apply for Parole in Place, a program that protects the parents of active-duty military personnel from deportation and provides a pathway to permanent residency.
Barranco’s lawyer, Lisa Ramirez, expressed relief at the decision, describing the arrest as traumatic and unnecessary, given Barranco’s lack of a criminal record. The Department of Homeland Security, however, has announced plans to appeal the ruling.
A Family’s Fight For Justice
Barranco’s case drew widespread attention due to his family’s military service. His son Alejandro, a U.S. Marine Corps veteran, criticized the use of force during the arrest, calling it excessive and inconsistent with his military training.
Alejandro, who assisted in the U.S. evacuation of Afghanistan in 2021, emphasized his father’s hardworking and kind nature. Barranco’s two other sons are currently active-duty Marines.
The case has reignited debates over the Trump administration’s immigration policies, particularly the targeting of individuals without criminal records.
While ICE officials defended their actions, claiming Barranco resisted arrest, his lawyer and family maintain that he posed no threat.
With his deportation case dismissed, Barranco now awaits the approval of his Parole in Place application, which could grant him a work permit and legal residency within six months.
