ICE Strikes Without Warrant–Constitution Under Fire
The incident raises alarms about a broader strategy of warrantless immigration enforcement.

According to the New York Times, Immigration and Customs Enforcement (ICE) carried out a workplace raid in New Jersey without a warrant following the inauguration of President Donald Trump, sparking outrage from local officials and immigrant rights advocates.
The raid, which involved the detention of both undocumented individuals and American citizens, raises alarms about the Trump administration’s potential shift towards a broader strategy of warrantless immigration enforcement.
The Alien Enemies Act
Lawyers within the administration argue that the Alien Enemies Act of 1798 grants the president the authority to bypass the need for a warrant when detaining noncitizens. In addition, it gives the president powers to deport foreign nationals during times of war.
The interpretation could pave the way for federal agents to enter private homes without judicial oversight, a development that could upend Fourth Amendment protections.
President Trump invoked the law in early January to justify deporting members of the Tren de Aragua, a Venezuelan gang accused of illegal activities in the United States.
Under the executive order, individuals suspected of being part of the gang could be apprehended without a court order, with senior Justice Department officials asserting that this historical precedent meant ICE could conduct warrantless searches of homes in pursuit of suspected gang members.
Warrantless Immigration Enforcement
The administration's interpretation of the law has drawn significant criticism. ICE officials have been accused of deporting individuals with little regard for the strength of their ties to criminal activity.
Reports suggest many deportees were sent to dangerous prisons in El Salvador based on questionable evidence, such as tattoos that were deemed incriminating, and raises concerns about serious human rights violations.
The broader legal and ethical implications of warrantless immigration enforcement are also under scrutiny. The Fourth Amendment, which protects citizens and residents from unreasonable searches, applies to everyone in the United States, regardless of legal status.
Christopher A. Wellborn, president of the National Association of Criminal Defense Lawyers, has warned that eroding this protection would constitute a dangerous abuse of power, jeopardizing privacy and safety for all Americans. It would leave individuals vulnerable in their own homes, creating a climate of fear and uncertainty.
Recent lawsuits have further illustrated the consequences of such policies. A case filed by the National Immigrant Justice Center and the American Civil Liberties Union accused ICE of violating the rights of 22 individuals, many of whom were detained without proper warrants.
A 2022 settlement in a class-action lawsuit placed limitations on warrantless arrests in several Midwestern states, yet ICE has continued to make arrests. Additional court cases are slowly making their way to the Supreme Court for a final ruling.
